Terms of Trade — Textile Rescue Manawatū

These terms apply to all purchases made through shop.textilerescue.nz and to the services Textile Rescue Manawatū Limited ("Textile Rescue", "we", "us") provides in connection with them. By placing an order, you agree to these terms.

1. Who we are

Textile Rescue Manawatū Limited is a New Zealand limited liability company based in Palmerston North. We are in trade. Contact: sonya@textilerescue.nz.

2. What you're buying

A Rescue Bag purchase is a textile recycling service: the sorting, rehoming, and recycling of up to approximately 5 kg of textiles, with return postage included. To deliver the service, we supply you with a Rescue Bag — a reusable collection bag that remains our property and circulates between customers, so it may show signs of previous use. That's by design; reuse is the point.

When you buy the service, we will:

1.     Deliver the bag to your nominated New Zealand address.

2.     Receive your filled bag when you lodge it at a NZ Post Shop.

3.     Sort the contents and route each item to the most appropriate destination, which may include resale, donation to charity, upcycling, recycling into new materials through our processing partners, or — only where no other option exists — responsible disposal.

We decide, at our reasonable discretion, the destination of each item. We do not guarantee any particular item will be resold, donated, or recycled into a specific product, and we cannot provide item-level tracking or return individual items once received.

3. Ownership

The Rescue Bag itself remains the property of Textile Rescue at all times. It is supplied for the sole purpose of collecting and returning textiles to us, and may not be on-sold or used for any other purpose.

Ownership of the textiles transfers to Textile Rescue when we receive your filled bag. By sending them, you confirm the items are yours to give and are free of any third-party claims. Any proceeds from resale belong to Textile Rescue and fund our operations and charitable purposes.

4. What you can and can't send

Accepted: clean, dry clothing and household textiles.

Not accepted: wet, mouldy, or contaminated items; items soiled with hazardous substances (chemicals, oil, bodily fluids); footwear; pillows, duvet inners, and foam- or feather-filled items; non-textile waste.

A full and current list of accepted and not-accepted items is published in the FAQ section of our website and forms part of these terms. The list as published at the time you lodge your bag applies. If this summary and the FAQ list differ, the FAQ list prevails.

If a bag contains unacceptable or hazardous material, we may dispose of those items responsibly without compensation, and we reserve the right to recover reasonable disposal costs from you where contamination is significant and deliberate or careless. Check your pockets — we are not responsible for personal items, valuables, or money left in clothing, though we'll make reasonable efforts to return anything of obvious value if you contact us promptly.

5. Price and payment

All prices are in New Zealand dollars and include GST. Payment is taken at checkout. We may change prices at any time, but changes don't affect orders already placed.

6. Delivery

We'll dispatch your Rescue Bag within 2 working days of your order. Delivery is by NZ Post to New Zealand addresses only. Where we are responsible for delivery, we'll ensure it arrives within a reasonable time. If your bag doesn't arrive, contact us and we'll replace it or refund you.

7. Using your bag

Your filled bag must be lodged at a NZ Post Shop using the prepaid postage attached to the bag. The prepaid postage covers up to approximately 5 kg; bags over the postage weight limit may be refused by NZ Post. Rescue Bags do not expire and may be lodged at any time while Textile Rescue remains in operation.

Please take reasonable care of your Rescue Bag while it's with you — it remains our property and goes on to serve other customers after you. If your bag is lost or damaged before use, contact us and we'll send one replacement free of charge per purchase. Further replacements are at our discretion and may be charged at cost.

8. Your rights under the Consumer Guarantees Act

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 (CGA) where you are purchasing for personal, domestic, or household use. The CGA guarantees that our products are of acceptable quality and our services are carried out with reasonable care and skill, are fit for purpose, and are completed within a reasonable time.

If we fail to meet a guarantee:

        For a problem that can be fixed, we will remedy it within a reasonable time (for example, replacing a faulty bag or completing the service).

        For a serious problem that can't be fixed, you may cancel and receive a refund, or seek compensation for any drop in value.

9. Change of mind

The CGA covers faults, not change of mind. If you change your mind, we'll refund a Rescue Bag purchase provided you notify us within 7 days of purchase and the bag is returned to us empty, posted back within 7 days of it arriving. Rescue Bags are reusable and circulate between customers, so signs of previous use are normal and don't affect your refund. Return postage for change-of-mind returns is at your cost. Once a bag has been lodged with NZ Post, the service is underway and the purchase can't be refunded for change of mind.

10. Business customers

If you are acquiring products or services from us in trade (for business purposes), you agree that the CGA and sections 9, 12A, and 13 of the Fair Trading Act 1986 do not apply, to the extent permitted by law, and that this is fair and reasonable. Separate written agreements govern our commercial decommissioning and pickup services.

11. Liability

To the maximum extent permitted by law, and except for your rights under the CGA, our total liability for any claim arising from a purchase is limited to the amount you paid for that purchase. We are not liable for indirect or consequential loss. Nothing in this clause limits liability that cannot lawfully be excluded.

12. Privacy

We collect personal information (name, contact details, delivery address) to process orders and provide our services, and we handle it in accordance with the Privacy Act 2020. We don't sell your information. You may request access to or correction of your personal information by contacting us.

13. Problems and disputes

If something's gone wrong, contact us first — most issues are sorted quickly at sonya@textilerescue.nz. If we can't resolve a dispute between us, you may take the matter to the Disputes Tribunal or the courts. These terms are governed by New Zealand law and the New Zealand courts have jurisdiction.

14. Changes to these terms

We may update these terms from time to time. The version published on our website at the time you place an order applies to that order.
